Terms of Service

1. Agreement to Terms

By accessing or using Atlas ("Service"), operated by Market Trendz, Inc. ("we", "us", "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our Service.

2. Description of Service

Atlas is an autonomous server monitoring and IT support platform. The Service includes:

• Server monitoring agent software
• Automated issue detection and remediation
• Dashboard for viewing server status and alerts
• AI-powered diagnostic and repair capabilities

3. Account Registration

To use the Service, you must:

• Provide a valid email address
• Be at least 18 years old
• Have authorization to install software on the servers you monitor

You are responsible for maintaining the security of your API key and all activity that occurs under your account.

4. Free Trial

New accounts receive a 30-day free trial. During the trial:

• Full access to all features
• No credit card required
• No automatic charges at trial end

After the trial period, continued use requires a paid subscription.

5. Pricing and Payment

After the free trial, the Service costs $29 per server per month. Payment is processed through Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period.

6. Server Access and Data

By installing the Atlas agent, you authorize us to:

• Collect system metrics (CPU, memory, disk usage)
• Read log files to detect issues
• Execute diagnostic commands
• Perform automated remediation actions

You retain ownership of your servers and data. We access only what is necessary to provide the Service.

7. Automated Actions and Data Risk

Atlas may automatically take actions to fix detected issues, including but not limited to: restarting services, modifying configuration files, clearing disk space, removing files, and executing shell commands. These actions may result in data loss or system changes that cannot be undone.

By using Atlas, you explicitly acknowledge and agree that:

• YOU ARE RESPONSIBLE FOR MAINTAINING BACKUPS - You must have current, tested backups of all critical data before using Atlas
• Atlas may delete, modify, or move files during automated repairs
• Automated fixes may not resolve all issues and may occasionally cause unintended side effects
• We are not responsible for any data loss, corruption, or system damage resulting from automated actions
• You have verified that your backup and recovery procedures are working

DO NOT USE ATLAS ON SYSTEMS WITHOUT RECENT, VERIFIED BACKUPS.

8. Acceptable Use

You agree not to use the Service to:

• Monitor servers you don't own or have authorization to access
• Engage in illegal activities
• Interfere with or disrupt the Service
• Attempt to reverse engineer the software

9. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Termination

We may terminate or suspend your account at any time for violations of these Terms. Upon termination, your right to use the Service ceases immediately. You may terminate your account at any time by uninstalling the agent and contacting us.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
